AEP Energy is a competitive retail electric generation service supplier and a retail natural gas service provider that is committed to respecting your privacy and ensuring transparency in how we collect, use, and share your personal information. This Privacy Notice outlines the types of information we collect, how it is used, and your choices regarding that information.

Personal Information We Collect

We collect personal information, which is any information that can be linked to or reasonably linkable to an identifiable natural person. The categories of personal information we collect include:

  • Customer records such as service address, contract details, and account information, such as energy usage data and meter identifiers.
  • Commercial information such as products or services purchased or considered.
  • Internet network and other electronic network activity information (IP address, device identifiers, log data, analytics, approximate location, and interactions with our websites and emails).
  • Audio, electronic, visual information such as call recordings and language/speech characteristics when you contact customer care, where legally permissible.
  • Inferences drawn to create a profile about your preferences.

There are many different points on which your personal information may be shared with us, including:

  • When you enroll in our service, contact us, or use our websites.
  • When you participate in marketing initiatives, customer offers, or surveys.
  • Automatically from your browser or device when you access our website through cookies, pixels, tags, session replay‑ tools, and other logging technologies.
  • From utilities and market operators.
  • From publicly available sources where permitted by law.

  • Provide, maintain, and service accounts; process enrollments, billing, and payments; and deliver customer support.

  • Service providers and contractors that process information on our behalf under written contracts for customer support, analytics and advertising, information security, and cloud hosting.

  • Law enforcement, regulators, and other parties when required or permitted by law, or to protect AEP Energy, our customers, or the public.

Cookies, and similar technologies such as pixels, are used by AEP Energy to help personalize your experience with us on our websites. Information from Business Partners and other Third Parties

The Company collects personal information through our Business Partners. This information may include contact information, such as name, company name, job title, address, e-mail address, and phone number.  The Company may also obtain personal information from other third-party sources, including publicly and commercially available sources. We may combine the information we receive from our Business Partners and other third-party sources with information that we collect from you or your device, as described above.

You have options regarding the personal information you provide to the Company. While you may choose not to disclose certain information requested, please be aware that this may impact our ability to offer you relevant products or services, or to enable specific features of the Website.

Targeted Advertising, Sales, and Sharing

We may use and disclose personal information (including online identifiers and interactions) for targeted advertising. We do not sell personal information for money. Where the use of personal information for targeted advertising or “sharing” (as defined by certain state laws) applies, you may opt out as described in “Your Privacy Choices.”

Your personal information will generally be stored in the Company’s databases or databases maintained by our service providers. Safeguarding personal information is a core priority at AEP Energy. We implement reasonable and appropriate measures to ensure the privacy, accuracy, and integrity of your data, and to protect it against loss, misuse, unauthorized access, disclosure, alteration, or destruction.

Your Privacy Rights

Certain state privacy laws provide rights for individual consumers, as outlined below.

  • Right to know and access personal information: You have the right to request that we disclose: (1) the categories of personal information we have collected about you; (2) the sources from which we collected the personal information; (3) the business or commercial purpose for the collection, selling or sharing of personal information; (4) the categories of third parties to whom we disclose personal information; (5) the categories of personal information that we sold or disclosed for a business purpose; and (6) the specific pieces of personal information we have collected about you.
  • Right to opt-out: You have the right to opt out of the sale or sharing of your personal information, the use of your personal information for targeted advertising, and the use of your personal information for profiling. If you use an opt-out preference signal following the global privacy control (GPC) specification, we will process your opt-out preference in a frictionless manner at the device level using our cookie compliance tool. You can set your browser to send these signals, but the specific settings that need to be configured depend on the specific browser you use. Some browsers may require a browser extension. For example, we may not be able to delete information that is necessary for us to provide you with services that are reasonably anticipated as part of our relationship with you as our customer. We also may not be able to delete information necessary to comply with our legal obligations, fulfill the terms of our agreements with you, or enable internal uses that are aligned with the reasonable expectations of customers of AEP Energy.
  • Right of portable copy: You have the right to obtain a copy of your personal data in a portable and readily usable format that allows you to transmit the data to another controller without impediment. There are some limits to this right.
  • Right to non-discrimination or retaliation: We will not discriminate or retaliate against you for exercising your privacy rights.

Right to Appeal

If we decline your request, you may appeal the decision to our senior management. Simply follow the same process for submitting a request and include “Appeal” in the title or other part of the request. Depending on the state in which you reside, if that Appeal is denied, you may be able to contact your Attorney General’s office to submit a complaint. Exercising your Rights

If you wish to exercise your privacy rights or have any questions or concerns about our privacy policies and information practices, please contact us through our AEP Energy Webform, at care@aepenergy.com or at 866-258-3782. To verify your request, you may need to provide proof of identity, such as non-personal information about your account. You may also designate an authorized agent to make a request. The agent will follow the same procedures described above. If you use an authorized agent, we may require proof that the agent acts on your behalf.

Only you or your authorized agent acting on your behalf may make a request to opt-out or limit. To have an authorized agent be recognized as acting on your behalf, a) verify your identity directly with AEP Energy customer service and provide explicit written authorization (signed by you) permitting your agent to act on your behalf; or b) provide (or have your agent provide) legal proof of Power of Attorney, Guardianship, or Conservatorship.

Your Privacy Rights Matter—No Matter Where You Live

AEP Energy serves customers across many states, and each state has its own privacy laws. While some laws require AEP to take specific actions, we are committed to honoring privacy rights for all our customers—regardless of where you live.

This Privacy Notice outlines how AEP Energy handles personal information and includes details required by certain state laws. Even if your state isn’t listed, you’re still welcome to submit a privacy rights request, and we’ll do our best to respond promptly and respectfully.

Links to Third-Party Internet Websites

AEP Energy Website may contain links to websites or mobile apps, social media platforms and other third-parties that are not operated by the Company. Some examples of links to a third-party website include those websites operated by our Business Partners, suppliers, advertisers, sponsors, licensors, and other third parties. When we link to other websites or embed their content, AEP Energy’s privacy practices no longer apply. You should refer to the privacy policy of that third party for information about their privacy policies and cookie practices.

Retaining Your Personal Information

Personal information is retained only for as long as it is necessary for the purposes provided in this notice or to meet other legal, regulatory, tax or accounting requirements. Children’s Privacy

We do not knowingly collect or share any information from children under the age of 16. If we learn that a child under the age of 16 has provided us with personal information, we will delete it in accordance with applicable law.
